Frequently Asked Questions About Personal Injury

At the Law Office of Megan E. Burke, LLC, in Toledo, clients benefit from my 20-plus years of experience in personal injury and insurance defense. It helps that I know both sides of the issue because I can anticipate what the insurance company is likely to do.

I am attorney Megan E. Burke, and I represent people in Ohio who have been injured or lost a family member in an accident. Please see the FAQ below and contact me if you have questions about your personal injury case. Your consultation with me is free.

How Much Does It Cost To Work With A Personal Injury Attorney?

I take personal injury cases on contingency fees, which means that I charge you nothing up front and you do not pay me anything unless I get compensation for you. If I do get a settlement or a jury award for you, my fees come out of that amount.

What Is The Statute Of Limitations For Filing A Car Accident Claim In Ohio?

In Ohio, you have just two years from the time of the accident to file a claim for injuries and/or damage to your vehicle. There can be exceptions to this timeline, so it is important to discuss the matter with your lawyer.

Do You Really Need A Lawyer For A Car Accident Case?

Yes, it is best to have a car accident attorney on your side after an accident. I will investigate the accident to determine the cause and liability. This is not something that you should try to do on your own. I will also handle communications with the insurance companies and negotiate with the negligent party’s insurer. If necessary, I will take your case to court to get the compensation you need.

Is A Truck Accident Different From A Car Accident?

Yes, commercial trucking cases and car accident cases are quite different. Trucking accidents typically involve multiple liable parties, commercial insurance policies and federal laws. You must have a lawyer with experience in these complex cases.

Will Your Personal Injury Case Go To Trial?

It depends on the case. The majority of car accidents and other types of personal injury accidents (dog bites, falls, motorcycle accidents, etc.) are settled through negotiations with the negligent party’s insurance company. This can take a few months or perhaps a year in many cases. In complex or high-stakes cases where the amount of compensation is high, negotiations may not be enough and the case may proceed to trial.

Can You Get Compensation For The Wrongful Death Of A Loved One?

Yes, you can file a wrongful death claim if a family member has died as a result of another party’s negligence. The damages you may recover can include:

  • Pain and suffering of your loved one
  • Medical bills from the accident
  • Loss of their contributions to the household
  • Loss of their salary and benefits
  • Funeral and burial expenses
  • Loss of consortium
  • Your emotional distress

Each case is different, so it’s important to discuss the details of yours with an experienced lawyer.
